Breach of Contract Insurance for Businesses in Texas Could Provide Leverage in Settlement Talks
Traditional insurance policies do not cover an insured for claims for breach of contract. However, a new line of insurance coverage may become available in Texas to offset at least some of the uncertainty associated with a business being sued, at least for breach of contract. In this article, I discuss the risk management benefits available to companies if they were able to procure insurance that would pay for the company's attorney's fees should it lose a breach of contract lawsuit.
